CITY COUNCIL

1.                  Subject:  Minutes

Recommendation: That Council waive the reading and approve the minutes of the regular meeting of August 1, 2006.

2.                  Subject:  Designation Of Deputy City Clerk  (170.02)

Recommendation: That Council approve the designation of Lori A. Cole as a Deputy City Clerk.

3.                  Subject:  Rental Agreement For Hilda Ray House  (570.05)

Recommendation: That Council authorize the Parks and Recreation Director to enter into an agreement with Tatum Marie Hernandez, for a 3-year rental agreement for the Hilda Ray House at Hilda Ray McIntyre Park, starting July 1, 2006.

4.                  Subject:  Design Services For Bohnett Park Expansion Project And Acceptance Of Grant Funding  (570.05)

Recommendation: That Council:

A.                 Accept the $201,000 in grant funds for the Bohnett Park Expansion Project from the State of California 2002 Resource Bond - Roberti-Z'berg-Harris - Urban Needs Basis Grant;

B.                 Authorize the General Services Manager to increase the current purchase order with Van Atta Associates, Incorporated (Van Atta), by $21,629 for landscape architectural design services for the Bohnett Park Expansion project for a total contract amount of $45,929; and

C.                Increase appropriations and estimated revenues by $201,000 in the Parks and Recreation Department Fiscal Year 2007 Capital Improvement budget for the grant funds.

5.                  Subject:  Introduction Of Ordinance For Assignment Of Lease Agreement No. 20,453 - Deli Sushi Go Go  (330.04)

Recommendation: That Council:

A.                 Approve an assignment of Lease Agreement No. 20,453 from David Kim and Wal Jo Kim, d.b.a. Deli Sushi Go Go, to Kyung Wang and Sarah Wang, for the 198 square-foot restaurant located at 119-B Harbor Way; and

B.                 Introduce and subsequently adopt, by reading of title only, An Ordinance of the Council of the City of Santa Barbara Approving an Assignment of Lease Agreement No. 20,453 from David Kim and Wal Jo Kim, d.b.a. Deli Sushi Go Go, to Kyung Wang and Sarah Wang, for the 198 Square-Foot Restaurant Located at 119-B Harbor Way, Commencing on September 22, 2006.

6.                  Subject:  Lease Agreement With Rachel Adams, Doing Business As Madame Rosinka  (330.04)

Recommendation: That Council approve and authorize the Waterfront Director to execute a five-year lease agreement with Rachel Adams, doing business as Madame Rosinka at 221-B Stearns Wharf, at a rent of $641 per month or 10% of gross sales, whichever is greater.

7.                  Subject:  Approval Of Map And Execution Of Agreements For 1221 Chino Street  (640.08)

Recommendation: That Council:

A.                 Approve and authorize the City Administrator to record Parcel Map No. 20,696 by Patricia Katherine Sturm, Trustee of the Patricia Katherine Sturm Trust, dated December 20, 1989, as to an undivided 53.9% interest, and Clint Lefler, an unmarried man as to an undivided 17.1% interest, and Katherine E. Bender, a married woman as her sole and separate property as to an undivided 29% interest, as Tenants in Common for a subdivision located at 1221 Chino Street, and find the Parcel Map in conformance with the General Plan for the City of Santa Barbara (City);

B.                 Approve and authorize the City Administrator to execute and record an Agreement Relating to Subdivision Map Conditions Imposed on Real Property; and

C.                Approve and authorize the City Administrator to execute and record an Agreement for Land Development Improvements.

8.                  Subject:  Response To The Report Of The 2005-2006 Santa Barbara County Civil Grand Jury Entitled "Legal Services In Santa Barbara, Very High Prices For Comprehensive Representation"  (150.04)

Recommendation: That Council authorize the Mayor to provide the City Council's response to the report of the 2005-2006 Santa Barbara County Civil Grand Jury entitled "Legal Services in Santa Barbara, Very High Prices for Comprehensive Representation."

NOTICES

9.                  The City Clerk has on Thursday, August 10, 2006, posted this agenda in the Office of the City Clerk, on the City Hall Public Notice Board on the outside balcony of City Hall, and on the Internet.

10.             Cancellation of the regular Redevelopment Agency meeting of August 15, 2006, due to lack of business.

11.             Subject:  Capital Improvement Projects Fourth Quarter And Annual Report For Fiscal Year 2006  (230.01)

Recommendation: That Council receive, for information only, the Capital Improvement Projects (CIP) Fourth Quarter and Annual Report For Fiscal Year 2006.

12.             Subject:  Conference With Labor Negotiator - Police  (440.05)

Recommendation: That Council hold a closed session, per Government Code Section 54957.6, to consider instructions to the City's labor negotiators, Bruce Barsook, Liebert Cassidy Whitmore, and Kristy Schmidt, Employee Relations Manager, regarding negotiations with the Police Officers' Association.

13.             Subject:  Conference With Legal Counsel - Pending Litigation  (160.03)

Recommendation: That Council hold a closed session to consider pending litigation pursuant to subsection (a) of section 54956.9 of the Government Code and take appropriate action as needed.  The pending litigation is Homes on Wheels, et al., v. City of Santa Barbara, et al., Santa Barbara Superior Court Case No. 1112384.
