CITY COUNCIL

1.                  Subject:  Minutes

Recommendation: That Council waive the reading and approve the minutes of the regular meeting of January 2, 2007 (cancelled due to lack of quorum), the special meeting of January 8, 2007 (cancelled due to withdrawal of appeal), and the regular meeting of January 9, 2007.

2.                  Subject:  Ordinance For Adoption For New Police Memorandum Of Understanding  (440.02)

Recommendation: That Council:

A.        Adopt, by reading of title only, An Ordinance of the Council of the City of Santa Barbara Adopting the Memorandum of Understanding Between the City of Santa Barbara and the Santa Barbara Police Officers' Association; and

B.        Adopt, by reading of title only, An Ordinance of the Council of the City of Santa Barbara Amending Ordinance No. 5356, the Management Salary Plan, for Fiscal Years 2005 through 2008.

3.                  Subject:  Records Destruction For Community Development Department  (160.06)

Recommendation: That Council adopt, by reading of title only, A Resolution of the Council of the City of Santa Barbara Relating to the Destruction of Records Held by the Community Development Department in the Housing and Redevelopment Division.

4.                  Subject:  Records Destruction For Administrative Services Department  (160.06)

Recommendation: That Council adopt, by reading of title only, A Resolution of the Council of the City of Santa Barbara Relating to the Destruction of Records Held by the Administrative Services Department in the Human Resources Division.

5.                  Subject:  Grant From California Department Of Boating And Waterways For Abandoned Vessel Removal  (570.03)

Recommendation: That Council:

A.        Authorize the Waterfront Director to execute an agreement with the California Department of Boating and Waterways accepting a $45,000 grant for the removal of abandoned recreational boats and associated hazards to navigation; and

B.        Increase Fiscal Year 2007 estimated revenue in the amount of $45,000 and appropriate the funds to the Waterfront Department's Fiscal Year 2007 Capital Budget.

6.                  Subject:  Parks And Recreation Community (PARC) Foundation Annual Report  (570.05)

Recommendation: That Council receive the Annual Report from the Parks and Recreation Community (PARC) Foundation for the period of September 1, 2005, through August 31, 2006.

7.                  Subject:  Grant Appropriation For The Parma Park Trust  (570.05)

Recommendation: That Council increase estimated expenditures and revenues by $68,618 in the Fiscal Year 2007 Parks and Recreation Department Miscellaneous Grants Fund for work at Parma Park.

8.                  Subject:  Declaration Of Firefighting And Rescue Equipment As Surplus, And Donation Of Said Equipment  (520.03)

Recommendation: That Council authorize the General Services Manager to prepare all documentation required to donate surplus firefighting equipment to U.S./Mexico Sister Cities Association.

9.                  Subject:  Set A Date For Public Hearing Regarding Appeal Of Planning Commission Approval For 1575 La Vista Del Oceano Drive

Recommendation: That Council:

A.        Set the date of February 13, 2007, at 2:00 p.m. for hearing the appeal filed by Matthew Edwards of the Planning Commission approval of an application for property owned by Gene Schecter and located at 1575 La Vista del Oceano Drive, Assessor's Parcel No. 035-170-022 and -023, E-1 One-Family Residence Zone, General Plan Designation: Residential, 3 Units per Acre.  The project proposes the merger of two vacant parcels and the construction of a new residence.  The discretionary applications required are Modifications and a Voluntary Lot Merger; and

B.        Set the date of February 12, 2007, at 1:30 p.m. for a site visit to the property located at 1575 La Vista del Oceano Drive.

NOTICES

10.             The City Clerk has on Thursday, January 18, 2007, posted this agenda in the Office of the City Clerk, on the City Hall Public Notice Board on the outside balcony of City Hall, and on the Internet.

11.             Received a letter of resignation from Water Commissioner Steven Little; the vacancy will be part of the next City Advisory Group recruitment.

CITY COUNCIL ADMINISTRATIVE AND ATTORNEY REPORTS

PUBLIC WORKS DEPARTMENT

12.             Subject:  Presentation On Revised Construction Management Program In The Public Works Department  (410.06)

Recommendation: That Council:

A.        Receive a presentation from Public Works Department staff on the addition of three new positions to the Construction Management staff in the Public Works Department; and

B.        Adopt, by reading of title only, A Resolution of the Council of the City of Santa Barbara, Amending Resolution No. 06-055, the Position and Salary Control Resolution for Fiscal Year 2007, Affecting the Public Works Department, Effective January 20, 2007.

13.             Subject:  Alternative Transportation Incentive Program Update  (670.01)

Recommendation: That Council receive a report from staff on plans to enhance the City employee Alternative Transportation Incentive Program.

14.             Subject:  Conference With Legal Counsel - Pending Litigation  (160.03)

Recommendation: That Council hold a closed session to consider litigation pursuant to subsection (a) of section 54956.9 of the Government Code and take appropriate action as needed.  The litigation is Michael Tocher vs. City of Santa Barbara, et al., U.S. District Court Case Number CV 05-7050 CAS (SSx).

15.             Subject:  Conference With Legal Counsel - Pending Litigation  (160.03)

Recommendation: That Council hold a closed session to consider pending litigation pursuant to subsection (a) of section 54956.9 of the Government Code and take appropriate action as needed.  The pending litigation is Janeways v. City of Santa Barbara, et al., SBSC Case Number 01111681.
